Terms of Service

Effective 2026-09-28 · Last updated 2026-10-09

Welcome aboard. These terms explain how booking a Lei'd Back Charters trip works, what happens if plans change, and how our gift certificates and website work. Lei'd Back Charters is run by Salty Girl Enterprises LLC ("we," "us," "our").

When you book or pay for a charter, buy a gift certificate or come aboard, you agree to these terms, so please read them first. They also apply when you use our website. If you're booking for a group, please share the main points with everyone coming along.

We've kept this in plain English. If anything is unclear, email hello@leidbackchartersfl.com or call or text 941-745-8500.

The short version

The main points, each linked to the full details below. The full terms are what count if anything's unclear.

  • A $100 deposit holds your date, and the balance is due on the day of your trip. You can also pay in full. Prices and payment
  • Cancel more than 48 hours ahead for a full refund. Within 48 hours, what you've paid isn't refunded. Cancellations and refunds
  • If the captain calls off your trip for weather, you choose a new date or a full refund. Weather
  • Six guests at most, and children and babies count. Guests and capacity
  • Every guest signs our waiver before boarding: one per guest, and a parent or guardian signs for anyone under 18. Sign the waiver
  • No-shows aren't refunded, and a dock pick-up fee is earned once the boat leaves for your dock. Arrival and no-shows
  • Bring your own food and drinks: 21 and over for alcohol, and no glass. Food and drinks
  • The captain's call on safety is final. Safety and conduct

Who we are

Lei'd Back Charters runs private, captained tritoon charters on Sarasota Bay, Little Sarasota Bay and around Midnight Pass, leaving from Osprey, Florida.

  • The boat: a 2026 22-foot Barletta tritoon with a double bimini for shade. Federal law limits it to 6 passengers, counting children and infants.
  • Your captains: Captain Kelly holds a U.S. Coast Guard 25-Ton Master license and Captain Joe a U.S. Coast Guard 100-Ton Master license. One of them runs every trip. You're our guests, not renters: you don't rent or operate the boat.
  • Where we leave from: Spanish Point Tiki Bar and Restaurant, 135 Bayview Dr, Osprey, FL 34229, unless we've arranged a private dock pick-up with you.

These terms work together with the liability waiver every guest signs before boarding (see Liability waiver). Our Privacy Policy explains how we handle your information, and our Trip Info page has the practical details for the day.

Booking and confirmation

There are two ways to book:

  • Pay online: set-price charters, with the $100 deposit or in full. Private charters and pick-ups over 15 miles can also be booked online with the $100 deposit, and your captain quotes the rest.
  • Request first: trips starting within 12 hours, and dock pick-ups that don't fit a tour's departure times or daylight. The booking form sends these to us as a request, or you can call or text us. Nothing is charged, and nothing is final, until a captain confirms with you.

Some pick-up distances have extra rules. See Private dock pick-up.

After you book, Captain Kelly or Captain Joe will contact you by phone, text or email to confirm your start time and trip details. Sunset trips follow that evening's sunset, so we'll confirm the exact time with you. If we can't run your date, we'll refund you in full.

If you leave checkout without paying, you won't be charged and your date isn't held.

Please give us accurate details: your name, how to reach you, the number of guests (children and infants included) and your children's ages, so we can bring life jackets that fit.

Who can book: you must be 18 or older to book a charter or buy a gift certificate, and at least one adult must be aboard every charter.

Prices and payment

  • Prices are per boat, not per person. One price covers your whole private group of up to 6. Current tours and prices are on our Tours & Pricing page. All prices are in U.S. dollars.
  • The tour price is the price of the charter itself. A private dock pick-up is a flat fee per boat on top of it (see Private dock pick-up).
  • What's included: your licensed captain, fuel, Bluetooth sound, a cooler with ice and bottled water, floats, masks and snorkels, and life jackets.

How you can pay online

  • $100 deposit (the standard option). Pay $100 now to hold your date. The balance (the rest of the price) is due on the day of your trip. Your captain will tell you how to pay it when they confirm your trip.
  • Pay in full. Pay the tour price plus any pick-up fee up front, and there's nothing left to pay on the day.

Sales tax: Florida sales tax (currently 7%: the 6% state rate plus Sarasota County's 1% surtax) is added to the trip price and any pick-up fee, on the deposit or full payment and then on the balance. It's never charged on tips or on gift card purchases, and it's still due on a trip paid with a gift card.

  • Private charters and pick-ups over 15 miles take the $100 deposit only. Your captain will quote the rest before your trip, and the balance is due on the day. Private charter: If the quote doesn't work for you, we'll refund your deposit in full. Pick-up by quote: If the pick-up quote doesn't suit you, start from Spanish Point instead, or we'll refund your deposit in full.

Tips are always optional. If you pay in full, the booking form offers a tip for your captain: 15%, 18%, 20% or a whole-dollar amount you choose ($1 to $1,000). Percentages are of the tour price only, not the pick-up fee, rounded to the nearest dollar. It starts at "No tip," and no tip is ever expected; plenty of guests prefer to tip on the boat. Tips are always refunded if your trip doesn't go ahead. If your trip is rescheduled, the tip moves with it.

Card payments are handled by Stripe on Stripe's own secure checkout page. We never see or store your full card number, and Stripe emails you a receipt. You can pay by card, or by Apple Pay, Google Pay or Link where your device supports them.

Pricing mistakes: if we ever show a clearly wrong price, we'll tell you before your trip. You can then pay the correct price or cancel for a full refund.

Cancellations, changes and refunds

This is the same cancellation policy you see when you book:

  • More than 48 hours: full refund
  • Within 48 hours: non-refundable
  • Weather cancellations by the captain: reschedule or full refund

What that means in practice

  • How we count 48 hours: back from your scheduled start time, using the time your message reaches us. For example, for a 2:00 pm Saturday trip, cancel before 2:00 pm Thursday for a full refund.
  • More than 48 hours before your trip: we refund everything you've paid, including any deposit, pick-up fee and tip.
  • Within 48 hours of your trip: what you've paid isn't refunded, except a prepaid tip, which we return. If you paid only the $100 deposit, you lose the deposit and we won't charge the balance.
  • A deposit on a price still to be quoted (a private charter, or a pick-up by quote): the price was never agreed, so the 48-hour rule doesn't apply to it. If the quote doesn't work for you, we'll refund your deposit in full. If the pick-up quote doesn't suit you, start from Spanish Point instead, or we'll refund your deposit in full.
  • Weather: if your captain calls off your trip for weather, you choose a new date or a full refund. See Weather and conditions.
  • If we can't run your trip for any other reason, you choose a new date or a full refund.

How to cancel: email hello@leidbackchartersfl.com or call or text 941-745-8500. Please include your name and your trip date.

Changing your date: we're happy to move your charter to another open date, so please ask as early as you can.

  • More than 48 hours before your trip, we'll move it at no charge.
  • Within 48 hours, a move depends on availability and is up to your captain. If we can't find a date that works, the cancellation policy above applies.
  • If the new charter costs more or less, we'll settle the difference.

How refunds work

  • A refund goes back to the payment method you used, and we send it as soon as we can. Your bank may take several business days to show it.
  • A full refund means the full amount you paid. We don't deduct card processing fees.
  • If you paid with a gift certificate, anything refundable goes back onto your gift certificate, not to you as cash.

Gift certificates have their own rules. See Gift certificates.

Weather and conditions

Florida weather changes fast, and safety comes first. Our captains check marine radar and water conditions before and during every trip.

  • The captain's call is final. If lightning, high winds, heavy storms or other conditions make a trip unsafe, your captain will call it off, and you choose a new date or a full refund.
  • Rain doesn't always mean a cancellation. If your captain judges the conditions safe, the trip goes ahead. If you'd rather not go in weather the captain considers safe, our usual cancellation policy applies.
  • Trips cut short: if weather, a mechanical problem or another safety issue forces us to end a trip early, your captain will offer a rescheduled trip or a partial refund.
  • Events outside our control: these include hurricanes and tropical storms, Coast Guard or law-enforcement orders, waterway or bridge closures and emergencies. If one of them stops your trip, you choose a new date or a full refund. We can't cover related costs such as travel or lodging.

Arrival, late arrivals and no-shows

  • Leave time to park and board. Directions and parking details come with your booking confirmation.
  • Sign the waiver before you arrive. Every guest signs our liability waiver: one per guest, and a parent or guardian signs for anyone under 18.
  • Running late? Call or text 941-745-8500. We'll wait as long as we reasonably can, but your trip still ends at its scheduled time so tides, sunset timing and later trips stay on track.
  • No-shows: if you don't arrive and we can't reach you, we treat it as a cancellation within 48 hours, so it isn't refunded.
  • Dock pick-ups: please be at your dock and ready at your pick-up time. The pick-up fee is earned once the boat leaves for your dock (see Private dock pick-up).

Private dock pick-up

We can pick you up and drop you off at a private dock, rental or marina, or do just one of the two.

  • One flat fee per boat, not per person, based on how far you are by water from our home dock at Spanish Point. Pick-up only or drop-off only costs about half the round-trip fee.
  • Your time on the water isn't cut. Your charter time starts at your scheduled pick-up time at your dock, so our trip out to you doesn't come out of it.

Distances, current fees and rules (also on our Trip Info page)

  • Under 1 mile: No pick-up fee.
  • 1–5 miles: $75 round trip, $40 one way. Sunset cruises welcome.
  • 5–10 miles: $175 round trip, $90 one way. Daytime charters starting 11:30am or later.
  • 10–15 miles: $250 round trip, $125 one way. 3-hour-plus daytime charters starting 12pm or later. We confirm within 24 hours, and refund you in full if we can't make it work.
  • Over 15 miles: Ask us for a quote (4-hour-plus daytime charters starting 12pm or later).
  • Sunset cruises from more than 5 miles away: we pick you up and finish at Spanish Point.

Your dock must be safe to reach. It needs room for us to pull up next to it and for everyone to step aboard safely at the tide on your trip day, and you need the dock owner's or rental manager's OK.

  • If we can't safely reach your dock, we'll tell you before we head out, meet you at the nearest public dock or at Spanish Point instead, and refund the difference in the pick-up fee (or take it off your balance, if you paid a deposit).
  • The pick-up fee is earned once the boat leaves for your dock. After that it isn't refundable, with two exceptions: if your captain calls off the trip for weather, the weather rule applies, and if we can't reach your dock, we refund the difference as described above.

Guests, children and capacity

  • Six guests at most. Federal law limits our boat to 6 passengers, counting children and infants, so the captain can't leave with more than 6 guests. Anyone over the limit will have to stay ashore, and we can't lower the price for them.
  • Children of all ages are welcome. A parent or responsible adult needs to watch their children at all times, aboard and at stops.
  • Life jackets: we carry Coast Guard-approved life jackets for every age, including properly fitted ones for children. Our rule: children under 6 wear one whenever the boat is moving. The captain may ask any guest to wear one at any time.
  • Mobility, medical and other needs: if anyone in your group has mobility needs or a health condition that could matter on the water, please tell us ahead of time and we'll help as safely as we can. Share only what the captain needs to know.

Safety, your captain and conduct

Your captain is in charge. For everyone's safety, the captain has the final say on the route, stops, swimming, the weather and anything else that affects safety. Please follow the captain's instructions, including the safety briefing and where to sit while the boat is moving.

  • Only our captain operates the boat. A guest may take the wheel only if the captain offers, and the captain stays in direct control the whole time.
  • The captain may change the route or stops, or head back early, because of safety, weather, tides or the law.
  • Bring lotion sunscreen rather than spray, because spray sunscreen makes the deck slippery.
  • Enjoy the wildlife from a respectful distance. Dolphins, manatees and many birds are protected, and we never feed or touch them.

Food and drinks (bring your own)

  • You're welcome to bring your own food, snacks and drinks. We supply a cooler with ice and bottled water.
  • Alcohol is for guests 21 and over only, so please bring a valid ID.
  • No glass. Bring cans or reusable containers.
  • Our captains don't drink while on duty, and the captain may limit or stop drinking aboard at any time.
  • Please follow local rules at beaches and sandbars.

When a trip can end early: illegal drugs aren't allowed aboard. The captain may end a trip early, without a refund, if any guest behaves in an unsafe, illegal or seriously disruptive way. That includes being too intoxicated, ignoring safety instructions, and harassing other guests or wildlife.

Pets, smoking and vaping: please ask us before your trip.

Liability waiver and assumption of risk

Sign the waiver: every guest must sign our digital liability waiver before boarding: one per guest, and a parent or guardian signs for anyone under 18. Anyone who hasn't signed it can't board, and that isn't a reason for a refund. The waiver is a separate agreement, and these terms don't replace it.

Any day on the water comes with some natural risks. Our captains take safety seriously, but some risks come with any boat trip, and you accept them when you join one. They include:

  • sun, heat and dehydration
  • changing weather, wind, waves and wakes from other boats
  • wet, slippery decks, and stepping between the boat and a dock or the shore
  • swimming, snorkeling and floating, with no lifeguard on duty
  • shallow water and sandbars, with uneven or sharp bottoms, shells, oysters and currents
  • marine life such as stingrays and jellyfish, and insects
  • other boats on the water

Swimming and sandbar stops happen only when the captain allows them, and you swim at your own risk. Please follow these rules:

  • Get in the water only when the captain says it's OK.
  • Stay where the captain can see you, and know your own swimming ability.
  • Children and weak swimmers must wear a life jacket in the water.
  • At the sandbar, shuffle your feet to warn off stingrays.

Some rights can't be waived by law, and nothing here tries to take them away. Where the law says we can't limit responsibility for our own negligence, we don't.

Your belongings and damage to the boat

  • Your belongings are your responsibility. Keep phones, cameras and sunglasses secure, because anything that goes overboard is usually gone for good. To the fullest extent the law allows, we aren't responsible for lost, stolen or damaged personal items unless our negligence caused the loss.
  • Left something behind? Please contact us and we'll help if we can.
  • Damage and cleaning: if your group damages the boat or its equipment, or leaves a mess that needs more than normal cleaning, we may ask you to pay the reasonable cost of repair or cleaning. There's no set fee, and we'll show you what it actually cost. Normal wear and tear is our cost, not yours.

Photos and social media

Your captain may take photos or short videos during your trip, and you're welcome to take as many as you like.

  • We share only photos of guests who've agreed, through the photo release in our waiver or by telling us. A parent or guardian decides for children.
  • You can say no on the day. Just tell your captain.
  • You can change your mind at any time. Email hello@leidbackchartersfl.com and we'll take photos of you or your child off our website and our own social media accounts.

Gift certificates (gift cards)

  • No expiration and no fees. Our gift certificates never expire, and we never charge inactivity, service or any other fees after you buy one.
  • Amounts: one of our tour prices, or any whole-dollar amount from $5 to $2,000 (U.S. dollars).
  • Buying one: pay online on our gift certificate page. Delivery is a digital PDF by email, or a printed certificate by USPS mail (U.S. addresses only). Captain Kelly or Captain Joe will be in touch to deliver it.
  • How to use it: each certificate has a gift code that looks like LB-XXXX-XXXX. Call or text us with the gift code when you book. Online checkout doesn't accept gift codes.
  • Good toward any charter, including dock pick-up fees. If your trip costs more than the certificate, you pay the difference. If it costs less, the leftover value stays on the certificate for another trip.
  • No cash back. Certificates can't be exchanged for cash, except where the law requires it.
  • Keep your gift code safe. It works like cash: anyone who has it can use it. Keep the certificate, your confirmation link and your receipt email private.
  • Lost or stolen certificates: please contact us. If our records confirm the purchase and the certificate hasn't been used, we'll cancel the old code and issue a new one.
  • All sales are final. Certificates never expire, so there's no rush to use one. If something went wrong with your purchase, such as a duplicate charge, contact us and we'll fix it.
  • Refunded or disputed payments: if the payment for a certificate is refunded or disputed, the certificate is cancelled and can't be used.
  • Free promotional certificates (a giveaway prize, for example) may have their own terms, including an expiration date. Any such terms will be shown on the certificate.

Using our website

  • Our content: the text, photos, logos and design on this site belong to us or are used with permission. You're welcome to share links to our pages. Please ask before copying or reusing our photos or content.
  • Use the site fairly. Don't send spam or automated messages through our forms, don't try to break or overload the site, and don't enter someone else's details without their permission.
  • Information, not guarantees: we work to keep prices, times and details accurate, but mistakes happen and things change. The weather readout and route map are for general interest only; they aren't forecasts or navigation tools. Sunset times are estimates, and your captain confirms your exact start time.
  • Other websites: our site links to services run by other companies, including Stripe (payments), Jotform (the waiver), Instagram, Facebook, Google Maps and Google reviews. Their own terms and privacy policies apply there, and we aren't responsible for their content.
  • Your information: our Privacy Policy explains what we collect and how we use it. If you give us your phone number, we may call or text you about your booking, trip-day weather, pick-up details or your gift certificate. We don't send marketing texts unless you ask for them. Message and data rates may apply. Reply STOP to stop our texts, and we'll reach you by email or phone call instead.
  • Accessibility: we want everyone to be able to use our site. If anything on it is hard to use, or you'd rather book by phone, please contact us and we'll help.

Limits on our liability

We stand behind our trips and want every one of them to be a great day. Some limits are still necessary. To the fullest extent the law allows:

  • We aren't liable for indirect losses, or other costs that follow from a problem, such as missed flights, travel or lodging costs, or changed plans. That applies whether the cause is weather, a cancellation or anything else.
  • For any claim that doesn't involve personal injury or death, our total liability is limited to what you paid us for the charter or gift certificate the claim relates to.
  • Nothing in these terms limits our liability for personal injury or death caused by our negligence, or any other liability the law doesn't let us limit.

Some rights can't be waived by law, and nothing here tries to take them away. Where the law says we can't limit responsibility for our own negligence, we don't.

Governing law and disputes

  • Talk to us first. If something goes wrong, please contact us. Most problems can be sorted out with a conversation.
  • Which law applies: these terms are governed by U.S. federal maritime law where it applies, and otherwise by the laws of the State of Florida.
  • Where cases are heard: unless the law says otherwise, any court case about these terms or a charter will be heard in the state courts of Sarasota County, Florida, or in the U.S. District Court for the Middle District of Florida.

Changes to these terms

  • We may update these terms from time to time. When we do, we'll post the new version here with a new "Last updated" date.
  • The terms in place when you booked apply to that trip, unless the law or safety requires a change.
  • If any part of these terms can't be enforced, the rest still applies.
  • Our agreement: these terms, the liability waiver and the trip details we confirm with you (date, time, price and meeting point) make up our agreement. Our Privacy Policy explains how we handle information but is not part of this contract. Only a written message from us that says it changes these terms can change them.
